Welcome to my online art store. By accessing this website or purchasing artwork, prints, or other products through my online store, you agree to the following Terms & Conditions.

Please read these terms carefully before placing an order.

1. About My Artwork

All artwork offered through this website is created by me and is either original, hand-crafted, or produced as described in the individual product listing.

Because my artwork is handmade and hand-crafted, no two pieces are necessarily identical. Small variations, imperfections, differences in texture, brushwork, colour, or finish may occur. These characteristics are a natural part of handmade artwork and are not considered defects. They are part of the individuality and beauty of owning an original, hand-crafted piece of art.

2. Artwork Images and Colours

I make every effort to photograph and represent my artwork as accurately as possible.

However, the appearance of an artwork may vary depending on:

Lighting conditions when the artwork is photographed
The colour and surroundings of the wall or space where the artwork is displayed
The lighting in your own home or display space
Your computer, tablet, phone, or other device
Individual screen settings, brightness, contrast, and colour calibration

For these reasons, the colours and appearance of artwork shown on your screen may differ slightly from the physical artwork.

By purchasing artwork online, you acknowledge and accept that minor variations in colour and appearance may occur.

3. Purchasing Artwork

You must provide accurate and complete information when placing an order.

By submitting an order, you confirm that:

You are legally capable of entering into a purchase agreement;
The information you provide is accurate and complete;
You have authority to use the payment method provided; and
You agree to pay the full purchase price and any applicable taxes and shipping charges.

I reserve the right to refuse or cancel an order where there is a reasonable basis to do so, including suspected fraud, pricing or listing errors, payment problems, or circumstances where the artwork is no longer available.

If I cancel an order after payment has been received, I will provide a refund of the amount paid for that cancelled order.

4. Prices and Availability

Prices are displayed in Canadian dollars unless otherwise stated.

I reserve the right to change prices, artwork availability, product descriptions, or other offerings at any time without prior notice.

A price change will not affect an order that has already been accepted and paid for.

Because many of my artworks are one-of-a-kind originals, availability is limited. An artwork is not considered sold until the purchase has been successfully completed and payment has been received.

5. Payment

Payment must be received before an order is processed or shipped.

Available payment methods will be displayed at checkout.

Payment processing may be handled by third-party payment providers. I do not have access to or store your complete payment-card information where payment is processed through an external payment provider.

6. Sales Are Final — No Refunds

All sales are final. Refunds are not provided for change of mind, incorrect size selection, colour preference, or other reasons unrelated to an issue covered by applicable law.

Please carefully review the artwork description, dimensions, photographs, and other information provided on the product page before purchasing.

If you have questions about an artwork before purchasing, you are welcome to contact me.

Nothing in these Terms & Conditions is intended to exclude or limit any rights or remedies that cannot legally be excluded or limited under applicable law.

7. Damaged Artwork

I take great care in packaging artwork for shipment.

If an artwork arrives damaged, please contact me as soon as possible and provide photographs of:

The artwork
The shipping package
Any visible damage to the package
The internal packaging materials

Please retain the original artwork and all packaging materials until the matter has been resolved.

Damage occurring during shipping may be subject to the applicable shipping carrier's claims process. Please refer to my Shipping Policy for additional information.

8. Commissions

If I offer commissioned artwork, commission arrangements may be subject to additional terms agreed upon before work begins.

A commission is not considered accepted until the terms have been agreed upon and any required deposit or payment has been received.

Because commissioned artwork is created specifically for the customer, commission deposits and payments are non-refundable, except where otherwise required by applicable law or agreed upon in writing.

I reserve the right to decline a commission request at my discretion.

9. Changes to Products and Services

I may add, remove, modify, discontinue, or change any artwork, print, product, service, pricing, description, or other offering on this website at any time.

I do not guarantee that any particular artwork or product will remain available.

Where an order has already been accepted and paid for, I will honour the terms of that order unless circumstances outside my reasonable control prevent me from doing so.

10. Intellectual Property and Copyright

All artwork, photographs, images, written content, logos, designs, graphics, and other materials appearing on this website are protected by copyright and other applicable intellectual-property laws.

All artwork remains the intellectual property of the artist unless ownership or copyright has been expressly transferred in writing.

Purchasing an original artwork or print does not transfer copyright to the purchaser.

Unless I provide written permission, you may not:

Reproduce an artwork
Copy or modify an artwork
Create derivative works from an artwork
Digitally reproduce or distribute artwork images for commercial purposes
Use artwork images for merchandise or resale
Claim the artwork as your own
Use my artwork or images as part of another commercial product or business

You may display artwork that you have legally purchased for your personal enjoyment.

11. Artist's Right to Reproduce Artwork

Unless otherwise agreed in writing, I retain the right to photograph, reproduce, publish, display, and promote images of artwork that I have created, including artwork that has been sold.

This may include displaying images of sold artwork on my website, social media, in portfolios, exhibitions, promotional materials, or other artist-related communications.

For commissioned artwork, any specific confidentiality or reproduction arrangements will be agreed upon separately where applicable.

12. Website Content

I make reasonable efforts to ensure that information on this website is accurate and current.

However, I do not guarantee that all descriptions, photographs, dimensions, prices, availability information, or other website content will always be completely accurate, current, or error-free.

I reserve the right to correct errors or omissions, including typographical, pricing, description, or availability errors.

13. Website Use

You agree to use this website lawfully and respectfully.

You must not:

Attempt to interfere with the operation or security of the website;
Use the website for fraudulent or unlawful purposes;
Copy or misuse website content;
Attempt to gain unauthorized access to the website or its systems; or
Use the website in a way that could harm the website, the artist, or other users.

I reserve the right to suspend or restrict access to the website where I reasonably believe that these terms have been violated or where necessary to protect the website or my business.

14. Third-Party Services and Links

This website may use third-party services, including payment processors, shipping providers, website hosting services, and other applications or integrations.

The website may also contain links to third-party websites.

I am not responsible for the content, availability, security, or privacy practices of third-party websites or services.

Your use of third-party services may be subject to their own terms and policies.

15. Limitation of Liability

To the extent permitted by applicable law, I will not be responsible for losses or damages arising from circumstances beyond my reasonable control, including website interruptions, technical problems, shipping delays, carrier disruptions, or events outside my reasonable control.

Nothing in these Terms & Conditions limits or excludes liability or consumer rights that cannot legally be limited or excluded under applicable law.

16. Suspension or Termination

I reserve the right to suspend, discontinue, or terminate the website, online store, or any particular product or service at any time.

I may also restrict or terminate access to the website where necessary to protect my business, website, intellectual property, or other users.

Termination of the website or a particular service will not affect obligations that arose before termination.

Your use of this website is also subject to my Privacy Policy, which explains how personal information may be collected, used, and protected.

18. Governing Law

These Terms & Conditions are governed by the laws applicable in the Province of Nova Scotia, Canada, together with applicable federal laws of Canada.

Any dispute relating to these Terms & Conditions will be subject to the applicable courts and laws of Nova Scotia and Canada, except where applicable consumer-protection law provides otherwise.

19. Changes to These Terms

I may update these Terms & Conditions from time to time.

When changes are made, the updated version will be posted on this website and the "Effective Date" will be updated.

Your continued use of the website after updated terms are posted constitutes acceptance of the revised terms, to the extent permitted by applicable law.
